Terms of Service

1. Service Description

CleverTalk is an artificial intelligence-powered audio transcription platform that transforms voice recordings into intelligent, actionable documents. Our services include:

• Automatic audio-to-text transcription using AI technology
• Intelligent content generation (summaries, meeting minutes, reports)
• Emergent suggestions based on contextual conversation analysis
• Management of recordings and generated documents
• Support for multiple languages (Spanish, English, Portuguese, and others)

2. Eligibility and Account Creation

Minimum Age Requirements:

• European Union: 16 years or older (or with parental consent)
• United States: 13 years or older (or with parental consent if under 18)
• Brazil: 18 years or older (or with parental consent)

When creating an account, you must provide accurate information, keep your account updated, and are responsible for all activity on your account.

3. Subscription Plans and Pricing

3.1 Plan Types

Free Plan:

• 300 monthly minutes included
• Full functionality
• No credit card required
• Minutes renew automatically each month
• Unused minutes DO NOT roll over

Paid Plans:

• Basic Plan: Monthly minutes + standard features
• Premium Plan: More minutes + advanced features
• Enterprise Plan: Unlimited/customized minutes + priority support

3.2 Minutes Management

• 1 minute of audio = 1 transcription minute consumed
• Minutes reset monthly on the renewal date
• Re-processing already transcribed audio DOES NOT consume additional minutes
• Manually editing transcriptions DOES NOT consume minutes

4. Cancellations and Refunds

How to Cancel:

• From the app: Settings > Subscription > Cancel subscription
• By email: info@clevertalk.ai with subject "Cancel subscription"

Refund Policy:

Monthly Plans: NOT refundable

Annual Plans: Prorated refunds available if:

• Cancel within first 30 days
• Consumed less than 10% of annual minutes
• First annual subscription (not renewal)

5. Acceptable Use

✅ Permitted Uses:

• Transcription of work meetings (with consent)
• Recording of journalistic interviews (with consent)
• Documentation of medical or legal consultations (with consent)
• Recording of educational classes or conferences
• Transcription of podcasts or own media content
• Personal voice notes

❌ Prohibited Uses:

• Recording conversations without required consent
• Violating privacy or data protection laws
• Harassment, threats, extortion, or intimidation
• Distributing copyrighted content without authorization
• Reverse engineering or decompiling the application
• Creating multiple accounts to circumvent limitations
• Generating deepfake audio with intent to deceive
• Hate speech, racism, or discrimination

6. User Responsibility in Recordings

Recording Laws by Jurisdiction:

• EU/Spain: Generally requires consent from ALL parties
• USA: Varies by state - some require one-party consent, others all-party
• Brazil: Requires consent from at least one party

CleverTalk is NOT responsible for recordings made without appropriate consent.

7. Use of Artificial Intelligence

AI Technologies Used:

• AssemblyAI: Automatic speech recognition for transcription
• OpenAI: Content generation (summaries, minutes, suggestions)

Accuracy Limitations:

• Estimated accuracy is 85-95%, NOT 100%
• Technical terms, proper names, or jargon may be transcribed incorrectly
• Summaries and suggestions are guidance, NOT binding
• Generated content requires human review
• Generated content DOES NOT constitute legal, medical, or financial advice

Content Ownership:

• YOU retain ALL rights over your original audio recordings
• YOU retain ALL rights over generated transcriptions and documents
• CleverTalk DOES NOT claim ownership over your content
• We DO NOT use your content to train AI models

8. Intellectual Property

All intellectual property rights over the Platform (trade name, logos, UI/UX design, source code, algorithms) are owned by Duckdik SLL.

9. Privacy and Data Protection

The processing of your personal data is governed by our Privacy Policy.

10. Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

Maximum Liability: The greater of (1) the amount you paid in the last 12 months, or (2) €100.

11. Termination

You may terminate your account at any time via Settings > Account > Delete account or by emailing info@clevertalk.ai.

We may suspend or terminate your account for Terms violations, payment failure, or fraudulent activity.

12. Governing Law

• EU/Spain Users: Laws of Spain, Courts of Madrid
• California Users: Laws of California, Courts of Los Angeles County
• Brazil Users: Laws of Brazil, Courts of consumer's domicile

13. Changes to These Terms

We may modify these Terms at any time. For material changes, we will notify you by email at least 30 days before they take effect.
